 <abstract xml:lang="en">
 <p>The article comprehensively analyzes the systemic gaps in Russian legislation related to the regulation of artificial intelligence (AI). Key legal challenges are considered: the problem of liability for harm, conflicts in the field of intellectual property and risks to the rights of personal data subjects. Based on the analysis of current norms, fragmentary industry regulation, judicial practice and the positions of leading scientists, the thesis about the insufficiency of the current approach is substantiated. The author concludes that there is an urgent need to adopt a special federal law "On Artificial Intelligence", which would establish uniform principles, define the status of an AI operator and ensure a balance between stimulating innovation and reliable protection of the constitutional rights of citizens.</p>

 <trans-abstract xml:lang="ru">
 <p>В статье комплексно анализируются системные пробелы в российском законодательстве, связанные с регулированием искусственного интеллекта (ИИ). Рассматриваются ключевые правовые вызовы: проблема ответственности за вред, коллизии в сфере интеллектуальной собственности и риски для прав субъектов персональных данных. На основе анализа действующих норм, фрагментарного отраслевого регулирования, судебной практики и позиций ведущих ученых обосновывается тезис о недостаточности текущего подхода. Автор приходит к выводу о настоятельной необходимости принятия специального федерального закона «Об искусственном интеллекте», который бы установил единые принципы, определил статус оператора ИИ и обеспечил баланс между стимулированием инноваций и надежной защитой конституционных прав граждан.</p>
