The article is devoted to the study of the theoretical and legal foundations of prosecutorial supervision of the procedural activities of inquiry bodies in criminal proceedings of the Russian Federation. The concept, essence, subject and limits of prosecutorial supervision are considered, the regulatory and legal foundations of its implementation, the peculiarities of the implementation of the powers of the prosecutor at the stage of preliminary investigation in the form of an inquiry are analyzed. Particular attention is paid to the current problems of legislative regulation of prosecutorial supervision related to the reform of criminal procedure legislation, the delimitation of the powers of the prosecutor and the head of the inquiry body, ensuring the legality of the inquiry, as well as protecting the rights of participants in criminal proceedings. Directions for improving the legislation and practice of prosecutorial supervision are proposed.
Статья посвящена исследованию теоретико-правовых основ прокурорского надзора за процессуальной деятельностью органов дознания в уголовном судопроизводстве Российской Федерации. Рассматриваются понятие, сущность, предмет и пределы прокурорского надзора, анализируются нормативно-правовые основы его осуществления, особенности реализации полномочий прокурора на стадии предварительного расследования в форме дознания. Особое внимание уделяется современным проблемам законодательного регулирования прокурорского надзора, связанным с реформированием уголовно-процессуального законодательства, разграничением полномочий прокурора и руководителя органа дознания, обеспечением законности при производстве дознания, а также защитой прав участников уголовного судопроизводства. Предлагаются направления совершенствования законодательства и практики прокурорского надзора.
