 <p>In December 2018, the Criminal Procedure Code of the Russian Federation was supplemented with a new procedural requirement for the mandatory participation of a specialist when removing electronic media and copying information from them. This innovation has significantly hampered the activities of the preliminary investigation authorities, as it has significantly complicated the procedural form of seizure of electronic devices that are used in everyday life (smartphone, laptop, flash drive, etc.). These circumstances have led to the fact that the law enforcement officer often departs from the application of the said procedural rule. The presented article summarizes the judicial practice of appealing by the defense against the non-application of the rules for the seizure of electronic media and copying information from them (art. 164.1 of the Code of Criminal Procedure of the Russian Federation) in criminal pre-trial proceedings. The position of the judicial authorities boils down to the fact that the investigator can independently decide on the need for the participation of a specialist when there is a risk of loss or change of information. The lack of a legal definition of the category of «electronic media» leads to the fact that digital technical devices can be seized as ordinary items without the application of special rules.</p>

 <trans-abstract xml:lang="ru">
 <p>В декабре 2018 года Уголовно-процессуальный кодекс Российской Федерации был дополнен новым процессуальным требованием об обязательном участии специалиста при изъятии электронных носителей и копирования с них информации. Данное нововведение значительно затруднило деятельность органов предварительного расследования, так как значительно усложнило процессуальную форму изъятия электронных устройств, которые используются в повседневной жизни (смартфон, ноутбук, флэш-накопитель и т.д.). Данные обстоятельства привели к тому, что правоприменитель часто отступает от применения названного процессуального правила. В представленной статье обобщается судебная практика обжалования стороной защиты неприменения правил изъятия электронных носителей и копирования с них информации (ст. 164.1 УПК РФ) в уголовном досудебном производстве. Позиция судебных органов сводится к тому, что следователь может самостоятельно принимать решение о необходимости участия специалиста, когда есть риск утраты или изменения информации. Отсутствие законодательного определения категории «электронный носитель информации» приводит к тому, что цифровые технические устройства допускается изымать в качестве обычных предметов без применения специальных правил.</p>
