<abstract xml:lang="en">

The article examines the evolution of doctrinal views on the nature of exclusive rights in Soviet civil law scholarship during the 1920s–1960s. It traces the transformation of the concept from the reception, during the New Economic Policy period, of the mechanism of private monopoly to the emergence of an original dualistic conception that denies the commodity nature of exclusive rights and replaces the proprietary entitlement with a moral right and a socially distributive claim to remuneration. By comparing the Soviet model with the contemporary legislation of Kyrgyzstan, Russia, and Uzbekistan, the article identifies three comparative parameters: the status of the object, the legal nature of rights in it, and their transferability. It concludes that, despite a doctrinal divergence between the two models, the Soviet doctrine retains its prognostic value for addressing the challenges posed by digitalization and artificial intelligence.

<trans-abstract xml:lang="ru">
