The article examines the dichotomy of individual and collective rights of Indigenous Small-Numbered Peoples of the North (ISPN) as a fundamental system-forming characteristic of their legal status. The author substantiates that the legal status of ISPN is not limited to a simple set of individual rights, but represents a dialectical unity in which the private-law interest of a specific individual is organically interconnected with the public-law interest of the entire socio-ethnic group. The constitutional and international legal foundations of the dichotomy of ISPN rights are analyzed, as well as federal legislation (the “three named laws”) that establishes a system of interaction between individual and collective rights. The article identifies a significant legal gap – the absence in the current legislation on the bar (advocacy) (Art. 1 of Federal Law No. 63-FZ) of such a client as a collective subject that is not a legal entity. Based on the analysis of judicial practice (the case of the ISPN Community “Nazym”), the necessity of expanding the circle of clients by including collective subjects is substantiated. The author proposes a specific wording for Part 1 of Article 1 of the Federal Law “On Advocacy and the Bar in the Russian Federation”. It is concluded that the dichotomous nature of ISPN rights must be taken into account when developing the methodology of advocacy activity, which implies possession of special knowledge in the fields of ethnology, psychology, culture and traditions of ISPN.

В статье исследуется дихотомия индивидуальных и коллективных прав коренных малочисленных народов Севера (КМНС) как фундаментальная системообразующая характеристика их правового статуса. Автор обосновывает, что правовой статус КМНС не сводится к простой совокупности индивидуальных прав, а представляет собой диалектическое единство, в котором частноправовой интерес конкретного физического лица органически взаимосвязан с публично-правовым интересом всей социально-этнической группы. Анализируются конституционные и международно-правовые основы дихотомии прав КМНС, а также федеральное законодательство («три именных закона»), закрепляющее систему взаимодействия индивидуальных и коллективных прав. В статье выявляется существенный правовой пробел – отсутствие в действующем законодательстве об адвокатуре (ст. 1 Федерального закона № 63-ФЗ) такого доверителя, как коллективный субъект, не являющийся юридическим лицом. На основе анализа судебной практики (дело Общины КМНС «Назым») обосновывается необходимость расширения круга доверителей за счёт включения коллективных субъектов. Автор предлагает конкретную редакцию ч. 1 ст. 1 Федерального закона «Об адвокатской деятельности и адвокатуре в Российской Федерации». Делается вывод о том, что дихотомическая природа прав КМНС должна учитываться при формировании методики адвокатской деятельности, что предполагает владение специальными знаниями в области этнологии, психологии, культуры и традиций КМНС.
